What BeforeEmpty is. BeforeEmpty is a private meaning layer for memories you choose to preserve—photos, moments, and stories turned into structured meaning (life moments, values, patterns, Memory Cards). It helps you save what you always meant to organize, before stories fade away. It is not a public social network, not an AI clone or digital twin of a real person, and does not claim ownership of your original media. It is designed for reflection and personal memory legacy—not psychological profiles, personality assessments, or judgments about other people.
1) What usually stays on your device
Photos, videos, audio, and documents are designed to remain under your control on your device and are not uploaded to our cloud storage as part of normal Preserve flows. Optional Vault keeps evidence files on disk you control. Drafts may also be stored locally in your browser (IndexedDB). Normal Ask flows likewise do not upload original media files to cloud storage APIs.
2) What we may store in the cloud
To run the service we may store: email address or other account identifiers you choose to provide; progress metadata (for example completion state and content/media hashes); billing or redeem-code state; and structured meaning summaries derived from memories you preserve (such as life-event titles/summaries, values, patterns, and Memory Card fields). We may store these structured summaries to provide the service; they are treated as personal data and handled according to these privacy practices. Where practical we prefer hashes and structured summaries over retaining full plaintext drafts as the primary cloud record.
3) When you preserve a memory
Text meaning you submit can be sent to our servers so your meaning layer (life events, values, Memory Cards, and related story signals) can update. You control what you write and attach.
4) When you use Ask memories or Deeper conversation
Your current message is sent to our backend to generate a reply. Optional PDF / Word (.docx) attachments may contribute extracted text as context for that reply. Photos, video, and audio are not analyzed in Ask—preserve them via Add a memory if they belong in your story. Replies are AI-generated approximations grounded primarily in memories you preserved—they do not represent or recreate a real person, and are not a real person speaking.
5) AI and infrastructure providers
To generate replies we may send a system prompt (meaning-layer and safety constraints), your message, and optional document context to third-party AI providers. Raw local media files are not sent in the current design. Providers may process data outside your country. Please do not include information you would not want processed by these providers (for example passwords, government IDs, or confidential third-party records). Family stories you choose to Ask about may still be sensitive—use Ask only if you accept third-party processing of that text.
6) Data use boundary
Your memories are used only to provide and improve BeforeEmpty services. We do not sell your personal memories, and we do not use your private content to train public AI models without your permission.
7) Export, backup, and deletion
ZIP export and Vault sync can include text, media, and metadata for recovery on devices you control. Reset or account-deletion flows clear cloud progress and this browser’s local IndexedDB records for the signed-in user where implemented. Account deletion requires an access code sent to your account email before cloud data is permanently removed. Deleting your account does not automatically delete files stored in your personal Vault folder, because those files are stored outside our control on your device.
8) Children
BeforeEmpty is intended for adults who are old enough to use the service under the laws where they live (age of majority where required). Adults may preserve memories involving children when they have the appropriate rights and permissions to do so. Children should not create accounts. If you are under the age of majority in your jurisdiction, do not create an account.
9) Your rights and choices
Depending on where you live, you may have rights to access, correct, export, or delete personal data we hold, or to withdraw consent for optional processing (for example turning off story learning). Contact support with your account email or ID. We aim to respond within a reasonable time during Beta.
10) Security and limits
We use reasonable technical and organizational measures, but no online service can guarantee absolute security. You remain responsible for device access, Vault folder permissions, and backups.
11) Policy changes
We may update this summary as the product evolves. Material changes will be reflected by updating the date/version shown above. Continued use after an update means you accept the revised summary for Beta purposes.
Beta · invite only. BeforeEmpty is in a private beta: access is by invite, and features, limits, pricing, and availability may change, pause, or end without prior notice beyond what we can reasonably communicate.
Service description. The product helps you preserve personal and family-related memories as a private meaning layer and optionally ask about what you preserved. It is not: a cloud photo album that takes ownership of your files; a public social network; an AI clone, digital twin, or recreation of a real person; legal, medical, counseling, or estate-planning advice; or a guarantee that AI replies match any real person.
Eligibility. You must be old enough to form a binding contract in your jurisdiction (and at least the age of majority where required). You are responsible for compliance with local law.
Your content and rights. You retain rights in content you upload or write. You grant us a limited license solely to host, process, and display that content as needed to operate the service (including extracting structured meaning and generating Ask replies). We do not claim ownership of your stories or media. We do not sell your personal memories or use your private content to train public AI models without your permission.
Others’ data and no third-party profiling. BeforeEmpty is designed for preserving your own life experiences and meaningful personal relationships. It is not intended for creating psychological profiles, personality assessments, or judgments about people who have not chosen to participate. If you include photos, stories, or details about other people, you confirm you have the legal right to do so and that your use respects their privacy and applicable consent rules. Do not upload unlawful, harmful, or unauthorized content. We encourage relationship-based storytelling and privacy-conscious writing: avoid unnecessary personally identifiable information (such as full legal names, addresses, phone numbers, identification numbers, or other sensitive details) unless you intentionally choose to preserve them as part of the memory.
AI boundary. Ask memories and Deeper conversation produce AI-generated text that may be incomplete or wrong. AI does not represent or recreate a real person. Do not treat outputs as statements by a living or deceased person, or as professional advice. The service is designed for reflection and memory exploration; it is not intended to replace relationships, grief support, therapy, or professional advice. Do not use the service to deceive others by presenting AI output as a real person’s speech.
Acceptable use. You agree not to misuse the service (including attempts to break security, scrape, spam, harass, infringe rights, create unauthorized profiles about others, or process data you are not allowed to process).
Availability. Uptime, model behavior, export formats, and third-party AI availability are provided on a best-effort basis during Beta. We may suspend access for maintenance, abuse, or legal risk.
Disclaimer and liability. To the fullest extent permitted by law, the service is provided “as is” without warranties of uninterrupted or error-free operation. Where liability cannot be excluded, our aggregate liability for claims relating to the Beta service is limited to the amounts you paid us for the service in the three months before the claim (or zero if you paid nothing), except where law prohibits such a limit (including fraud or willful misconduct).
Termination. You may stop using the service and request account deletion. We may suspend or terminate accounts that violate these terms or create legal or security risk. Account deletion does not automatically remove Vault files stored on your device outside our control.
Governing law. These Beta terms are intended as a working summary. Governing law, venue, and dispute resolution will be stated in a formal agreement before public launch (typically the jurisdiction of the operating entity). If a formal agreement conflicts with this summary, the formal agreement controls.
Beta commercial status. Redeem codes, credits, and paid plans (if offered) may be for testing or early access and can change before public launch. Prices and entitlements shown in-product control during Beta.
What may be refundable. Where you purchased a paid plan or credit pack directly from us, you may request a refund subject to purchase records, unused balance, and anti-abuse checks. Promotional or complimentary credits are generally non-refundable.
How to request. Contact support with: account email or ID, payment or redeem reference, approximate purchase time, and reason. We aim to review Beta requests within a reasonable period (target: several business days).
When we may decline. We may decline refunds where credits or entitlements were substantially consumed, where we detect abuse or chargebacks in bad faith, or where the offer was marked non-refundable. Statutory consumer rights in your country (if any) are not waived by this Beta note where they cannot legally be waived. Nothing in this policy limits rights that cannot legally be waived.
Final policy. A full public refund policy will be published at or before general launch. Until then, this section is the operative Beta summary.
